U.S. Citizenship

Ahere are several groups of individual that can apply for citizenship. Foreign Nationals who have been in the U.S. in permanent resident status for at least 5 years are eligible for permanent resident status. If the permanent resident status was acquired based on marriage to a U.S. Citizen spouse, the foreign national only needs to be in the U.S. in permanent resident status for 3 years. In either situation, lengthy trips outside of the U.S. while in legal permanent resident increases the amount of time a legal permanent resident must wait to apply for citizenship.

If a foreign national was arrested or convicted for certain types of criminal activity while a legal permanent resident, their eligibility to apply for citizenship maybe adversely affected. Please note that not all arrests or convictions affect an application for citizenship. If you have any criminal or arrest history, our office will carefully your criminal record to see how your application for citizenship might be affected.

If you are a U.S. Citizen who has biological or adopted minor children born outside of the U.S., those children can apply for citizenship by virtue of your citizenship. It is important that your children take this step before the age of 18. If your children do not apply for citizenship by the age of 18, they will not be able to make such a claim based on your citizenship. They will then need to establish their own eligibility to apply for citizenship.
