Job Duties
- Assess and evaluate a client’s eligibility for immigration benefits or relief, considering relevant legal criteria and documentation.
- Gather evidence and information from the clients or witnesses relevant to their cases.
- Revise documents and information for submission to the appropriate federal agency.
- Interview with clients and evaluate other outcomes or strategies for their cases.
- Prepare, draft, and submit, legal documents and Immigration petitions, such as adjustment of status, naturalizations, consular process, immigrant visa petitions/applications, asylums, and cancellation of removal.
- Prepare, review, and submit legal and court documents, including briefs and court filings. Handle and ensure case progression through ongoing legal research and communication. Represent clients in Immigration court and federal government agencies.
- Conduct research and analyze relevant case law, legal precedent, and regulations to prepare for court cases.
- Provide legal opinions and advice, attend USCIS interviews, and represent clients in court and before ICE. Prepare case status report, evaluation and developing strategies for the efficient management and progression of cases.
- Assign and prioritize case workload among paralegals to ensure timely and efficient case handling.
- Supervise paralegal on case strategies, document preparation and communication with clients.
- Review and approve case strategies and filings prepared by legal support staff like petitions/applications to USCIS or in court submissions.
- Review drafts of immigration petitions, supporting documentation, and client communication prepared by paralegals.
- Develop and implement internal procedures to improve workflow and increase case handling across the legal team.
- Monitor compliance with legal and ethical standards among paralegals with the work being done.
- Train any new paralegal or client support on immigration law procedures, office protocols, and office management procedures to ensure consistency with office work.
- Monitor case progress and deadlines through regular check-ins and team meetings with paralegal and client support team.
- Perform administrative and strategic tasks aimed at enhancing the performance of the caseload.
Requirements
- Juris Doctor (J.D.) or Master of Laws (LL.M) from an ABA accredited law school and 1 year of experience as a law clerk, paralegal, or related.
- The 1 year of experience as a law clerk, paralegal, or related, must include: researching the INA and other laws relating to asylum; cancellation and withholding of removal; the Convention Against Torture; naturalization, consular processing, and immigrant visa petitions/applications; drafting and preparing US immigration benefit requests and legal documents for submission to government agencies and departments; and evaluating clients’ eligibility for US immigration benefits.
- Must be admitted to practice law in at least one US state or the District of Columbia.
- Position is based at 18310 Montgomery Village Ave., Suite 250, Gaithersburg, MD 20879. Travel to local USCIS office (approx. 0-1x/week) to attend client interviews or local court to attend hearings. Rate of Pay: $123,157.00/year.
