How Rideshare Insurance Coverage Works in Maryland
The compensation available after a rideshare crash depends on a tiered insurance structure tied to the driver’s app status at the moment of impact. Which tier applies is often the first dispute in any rideshare claim.
The three coverage tiers generally work as follows:
App off: Only the driver’s personal auto insurance applies. Personal policies frequently exclude commercial use, which can leave injured parties without a clear path to recovery.
App on, no ride accepted: Uber and Lyft typically provide contingent liability coverage of up to $50,000 per injured person, $100,000 total bodily injury per crash, and $25,000 for property damage, but only if the driver’s personal policy denies the claim.
Ride accepted through drop-off: The rideshare company’s commercial policy generally provides up to $1,000,000 in liability coverage once a passenger is aboard. Note that in Maryland, Lyft’s liability limit during the en-route-to-pickup phase can be lower than the full $1,000,000 that applies during the ride itself. Uber and Lyft may also carry uninsured and underinsured motorist coverage during this phase for passengers injured by a third-party driver, though availability can vary.
