Maryland Impaired-Driving Charges & License Consequences

A DUI & DWI matter can involve two separate proceedings: the court case and an administrative license action through the Maryland Motor Vehicle Administration. The deadlines and potential outcomes in one proceeding aren’t necessarily the same as those in the other. Maryland distinguishes between driving under the influence of alcohol and driving while impaired by alcohol. Driving under the influence is the more serious offense. A blood alcohol concentration of .08 or higher can support a driving under the influence per se allegation, while a driving while impaired charge doesn’t require a .08 result and may be based on the test result and other evidence.

Under Maryland’s implied-consent law, a driver detained on suspicion of impaired driving may be asked to take a chemical test. A refusal or qualifying test result can trigger an administrative license suspension and the right to request a Maryland Motor Vehicle Administration hearing. The effect depends on the result, prior history, accident circumstances, applicable notice, and other facts.

Maryland DWI Charges

Driving while impaired by alcohol is less serious than driving under the influence under Maryland law, but it can still carry incarceration, fines, probation, treatment requirements, and driver’s license consequences. A judge is not required to impose the maximum penalty. The potential sentence can change based on the statutory subsection, prior convictions, alcohol concentration, whether a minor was in the vehicle, and other aggravating circumstances.

A court-imposed sentence and a Maryland Motor Vehicle Administration sanction are separate consequences. Treatment, restricted driving privileges, license suspension, or ignition interlock participation may apply depending on the case disposition and the driver’s administrative record.

Maryland DUI Charges

A driving under the influence charge may be based on an allegation that alcohol substantially impaired the driver’s normal coordination or that a chemical test showed a blood alcohol concentration of .08 or higher. The number alone doesn’t resolve every issue. Testing procedures, admissibility, timing, officer observations, field sobriety testing, and surrounding evidence can all require review.

Possible consequences include incarceration, fines, probation, treatment, license sanctions, and ignition interlock requirements. Repeat allegations can be treated differently from a first allegation, and enhanced consequences may apply when a minor was being transported. Accident facts and allegations involving drugs, alcohol, or both can also affect the charges and available penalties.

Additional DUI & DWI Consequences

Some first offenders may qualify for Probation Before Judgment, often called PBJ. This is a disposition in which the court stays the entry of a judgment of conviction and places the person on probation. Eligibility and consequences depend on the charge, prior record, and case circumstances. PBJ doesn’t automatically prevent license consequences, ignition interlock requirements, insurance changes, or other collateral effects.

Prior impaired-driving cases can influence the treatment of later charges, including available sentences and license sanctions. Repeat-offense consequences depend on the number and timing of prior matters, the current charge, and the applicable Maryland law. Community service, probation, alcohol treatment, and attendance at a Victim Impact Panel may also be ordered.

Participation in Maryland’s Ignition Interlock Program may be required after PBJ or a conviction for driving under the influence or driving while impaired. The program can involve installing an approved device, completing recurring monitoring, complying with restricted-license terms, and responding to reported violations. Eligibility and program requirements may vary based on alcohol concentration, refusal, prior history, commercial-driver status, disposition, and Maryland Motor Vehicle Administration rules.

Employment, insurance, transportation, and family responsibilities may also be affected by an impaired-driving allegation.
