Who Can Seek a Peace Order in Maryland?
Maryland peace orders are governed by Maryland Code, Courts and Judicial Proceedings § 3-1501 et seq. They’re generally available to people who aren’t eligible for a protective order because they don’t have a qualifying domestic or household relationship with the other party.
A peace order may apply to disputes involving neighbors, coworkers, acquaintances, strangers, and non-cohabitating dating partners. An employer may also file a petition on behalf of a threatened employee. The person seeking relief must be a Maryland resident, or the covered act must have occurred in Maryland.
Peace Orders vs. Protective Orders
Protective orders apply to specified domestic and family relationships, while peace orders address alleged conduct involving people outside those relationships. Selecting the wrong statute can result in dismissal at the hearing stage, making the parties’ relationship a central issue from the beginning.
Peace order proceedings are heard in Maryland District Court. They don’t include custody or housing provisions.
Conduct That May Support a Peace Order
A petitioner must file within 30 days of the act described in the petition. To obtain relief, the petitioner must establish by a preponderance of the evidence that the respondent committed a listed act and is likely to commit another listed act in the future. This standard requires showing that the allegation is more likely true than not true.
Conduct recognized as grounds for a peace order includes:
Serious bodily harm or conduct causing fear of imminent serious bodily harm
Misuse of telephone facilities or electronic communication
Revenge porn or criminal harassment
Intentional visual surveillance of a private residential area
Intentional visual surveillance became a listed ground on October 1, 2025. It concerns areas of a residence where the petitioner has a reasonable expectation of privacy. Because the filing deadline and statutory grounds matter, we assess the timing and substance of the allegations before developing a strategy.
Our Approach to Peace Order Cases in Montgomery County
We begin by listening to your account and identifying your immediate legal concerns. We then review the available information and develop a strategy and timeline based on whether you’re seeking protection or responding to a petition.
We pursue negotiation when appropriate and prepare to litigate when necessary. For petitioners, that means presenting the alleged conduct and requested relief clearly. For respondents, it means examining the allegations, evidence, and possible consequences while accounting for related legal concerns.

Interim, Temporary & Final Peace Orders
Maryland law provides interim, temporary, and final stages of peace order relief. The applicable stage depends in part on when the petition is presented and what the judicial officer finds from the information provided.
Interim Peace Orders When the Maryland District Court clerk’s office is closed, a petitioner may seek an interim order from a District Court Commissioner. The commissioner may issue it upon finding reasonable grounds to believe that the respondent committed a listed act and is likely to commit another listed act in the future.
Temporary & Final Orders A temporary peace order generally remains effective for seven days unless a judge extends it. A final peace order lasts for the period stated in the order, up to six months. After notice and a hearing, a judge may extend it for good cause for as long as six months beyond its original term.
Relief Available Under a Final Peace Order
The order may prohibit further acts or threats, contact, or harassment. It may also bar the respondent from entering the petitioner’s residence or appearing at the petitioner’s employment, school, or temporary residence.
The court must limit relief to what’s minimally necessary to protect the petitioner. Peace orders don’t provide every remedy available under Maryland’s protective-order statutes, so the requested terms must fit this specific legal process.
Consequences of Violating an Order Violating no-contact or stay-away terms in an interim, temporary, or final order is a misdemeanor. A first violation carries up to 90 days in jail, a fine of up to $1,000, or both. A second or subsequent violation carries up to one year in jail, a fine of up to $2,500, or both.
Civil Peace Orders & Related Criminal Proceedings
A peace order is a civil order, not a criminal conviction. The court decides the civil case under the preponderance-of-the-evidence standard, which differs from the higher burden required for a criminal conviction.
The conduct alleged in a petition may nevertheless lead to separate criminal charges. Testimony from the peace order hearing may also be used in a criminal proceeding, so statements made in the civil hearing can have implications beyond the requested relief.
We evaluate these overlapping concerns when advising respondents and preparing for court. We also explain to petitioners how the civil petition, supporting evidence, and any related proceedings may interact.
