Removal of Conditions in Maryland

Form I-751 Guidance When Family Circumstances Change

Removing the conditions on marriage-based permanent residence requires the correct filing path, timely action, and evidence that the marriage was genuine. Anthony A. Fatemi, LLC assists conditional residents with Form I-751 petitions, including cases complicated by divorce or related family-court proceedings.

Our attorneys have represented clients in Maryland since 1999. Because we handle both immigration and family-law matters, we can address overlapping legal issues when a marriage ends during the two-year period. We also provide multilingual communication for Maryland’s diverse communities.

Who Must File Form I-751?

Form I-751, Petition to Remove Conditions on Residence, is used by people who obtained conditional resident status through marriage. The petition asks U.S. Citizenship and Immigration Services (USCIS) to remove the conditions and grant permanent status without the two-year limitation.

A married couple generally files jointly during the 90-day period immediately before that status expires. The window is measured backward from the second anniversary of the date conditional residence was granted, not from the wedding date or the date the physical green card arrived.

Late Joint Petitions
A Form I-751 filed with a spouse after conditional status expires must include an explanation showing good cause and extenuating circumstances for the delay. We assess the reason for the delay and the available documentation before preparing the submission.

Waivers of the Joint Filing Requirement

A resident may qualify to file without a spouse by requesting a waiver of the joint filing requirement. Unlike a joint petition, a waiver petition may be filed at any time before conditional status expires.

USCIS recognizes waiver grounds that include:

  • The petitioning spouse died.
  • The marriage ended through divorce or annulment.
  • The resident or the resident’s child experienced battery or extreme cruelty.
  • Removal would cause extreme hardship.

Each path requires evidence tailored to its legal requirements. A divorce waiver focuses on a marriage entered in good faith that later ended. Battery or extreme-cruelty and extreme-hardship waivers require different factual showings.

Form I-751 After Divorce in Maryland

Divorce doesn’t eliminate the obligation to file Form I-751. Someone who divorces before the two-year period ends must still seek removal of conditions and meet the requirements for filing without a spouse.

When divorce affects a resident’s case, we handle the immigration petition and related family-court proceedings. This coordinated approach allows us to evaluate the filing in the context of the divorce rather than treating the two matters as unrelated.

Before recommending a path forward, we consider the marriage history, the status of the family-court case, and the resident’s immigration circumstances.
